Terms & Conditions

Welcome to Real Time Properties (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your registration as an Agent and your use of our platform. By checking the “I accept” box during registration, you agree to be bound by these Terms. If you do not agree, please do not register or use our services.

To register as an Agent, you must:

• Be at least 18 years old and legally capable of entering into contracts under Kenyan law.
• Provide accurate, current, and complete information (full name, email, phone number, profile picture).
• Provide a valid government‑issued ID (National ID Card, Passport, or Alien Card) before your account is approved. We may require you to upload a clear copy of your ID for verification.
• Keep your login credentials confidential and notify us immediately of any unauthorised use of your account.

We reserve the right to reject any registration or suspend / terminate an Agent account if you provide false information, impersonate another person, violate any of these Terms, or fail to provide a valid government ID.

As an Agent, you may upload property listings. You agree that:

• All property details (price, location, images, description) are truthful, not misleading, and comply with relevant Kenyan real estate laws (e.g., Estate Agents Act, Land Act).
• You have the legal right or authorisation to list the property.
• You will not post prohibited content (e.g., discriminatory statements, illegal offerings, spam, or fraudulent listings).
• We may remove any listing that violates these Terms or is reported as inappropriate.

We provide a platform only and do not verify the accuracy of every listing. We disclaim liability for errors or omissions. However, we actively take action against reported violations.

If you violate these Terms (e.g., providing false information, listing illegal properties, failing to provide a valid ID, or engaging in fraud), we have the right to:

• Temporarily suspend your account pending investigation.
• Permanently terminate your account if the violation is severe or repeated.
• Remove all your listings from the platform.

We will not be liable for any loss resulting from the suspension or termination of your account due to your breach of these Terms.

All users (Agents and visitors) must:

• Not use the platform for unlawful purposes, harassment, or to infringe on others’ rights.
• Not interfere with the security or functionality of the website.
• Respect the intellectual property rights of others.

Agents are solely responsible for their interactions with potential buyers / renters. Any agreements, deposits, or contracts are between the Agent and the client. We are not a party to those transactions and shall not be held liable for any disputes, losses, or damages arising from them.

Currently, Agent registration is free. We reserve the right to introduce paid plans or fees for premium features. Any changes will be communicated at least 30 days in advance. You are responsible for any taxes applicable to your transactions under Kenyan tax laws.

All content on Real Time Properties (logos, design, text, graphics) is owned by us or our licensors. You may not copy, modify, or redistribute without written permission. However, you retain ownership of the property images and descriptions you upload, but you grant us a non‑exclusive, worldwide license to display, distribute, and promote your listings on our platform and affiliated channels.

We collect and process your personal data (name, email, phone, profile picture, government ID) in accordance with the Kenya Data Protection Act, 2019 and our Privacy Policy. By registering, you consent to such collection and use for providing our services, including communication about listings and platform updates. We do not sell your data to third parties.

The platform is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted, error‑free, or secure. To the fullest extent permitted by Kenyan law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non‑infringement.

To the maximum extent permitted by the laws of Kenya, Real Time Properties, its owners, employees, or affiliates shall not be liable for any indirect, incidental, or consequential damages (including loss of profits, data, or goodwill) arising from your use of the platform, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed KES 10,000 (Ten Thousand Kenyan Shillings).

Furthermore, we shall not be liable for any loss, injury, contractual dispute, or claim arising from transactions between Agents and clients, the accuracy of property listings, or the conduct of any Agent. Each Agent is responsible for conducting their own due diligence and complying with real estate laws.

You agree to indemnify and hold harmless Real Time Properties from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your property listings, or your interactions with other users.

We may suspend or terminate your Agent account at our discretion if you violate these Terms, or if we suspect fraudulent activity. You may also delete your account at any time by contacting support. Upon termination, your listings will be removed, and you must cease using the platform.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya (including the Law of Contract Act, Cap 23, and the Arbitration Act, Cap 49). Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiations. If unresolved, the dispute shall be submitted to binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act, 1995 (Cap 49). The arbitration shall be conducted by a single arbitrator mutually agreed upon, or appointed by the Chartered Institute of Arbitrators (Kenya Branch). The costs of arbitration shall be shared equally unless the arbitrator decides otherwise.

We may update these Terms from time to time to reflect legal or platform changes. We will notify you via email or a prominent notice on the website. Continued use after changes constitutes acceptance of the revised Terms.
